7. The High Court rejected Baile’s retrial application in favor of the Chinese pen industry;
On September 28, 2021, the Supreme People’s Court of the People’s Republic of China (2020 Supreme Court Xingshen No. 4945 Administrative Ruling) rejected the retrial applicants Baile Ink Co., Ltd., Baile Co., Ltd. (hereinafter referred to as Baile) and the respondent country. Retrial application of the Intellectual Property Office and the first instance third party, China Pen Makers Association, in the case of administrative dispute over invalidation of invention patent right.
The applicant for the retrial, Baile, refused to accept the Administrative Judgment (2019) Jingxingzhong No. 124 of the Beijing Higher People’s Court and applied to the High Court for a retrial. Baile applied for a retrial, claiming that the second-instance judgment found that the relevant claims of the patent involved were not inventive and there was an error, and requested the High Court to revoke the invalidation decision and the first-instance and second-instance judgments.
The High Court held that Baile’s application for retrial did not meet the circumstances stipulated in Article 91 of the Administrative Litigation Law of the People’s Republic of China. In accordance with the provisions of Paragraph 2 of Article 116 of the Interpretation of the Supreme People’s Court on the Application (Administrative Litigation Law of the People’s Republic of China) and Article 4 of the Provisions of the Supreme People’s Court on Several Issues Concerning the Handling of Administrative Retrial Cases, The High Court formed a collegial panel to conduct a review and rejected Baile’s application for retrial.
